Terms & Conditions between Customers to the DeliShops platform and ClicBox Ltd

Who are we?

ClicBox Ltd owns the DeliShops platform

 

How does it work?

We supply DeliShops – online shops attached to the DeliShops platform - to Retailer Partners (“Retailers”).  The platform is also connected to Suppliers Partners (“Suppliers”) of goods who sell their products through the Retailer’s DeliShop direct to you the Customer.

The Retailer chooses what to sell both of their own products, if they sell any, and from other Suppliers.  Products purchased from other Suppliers are dispatched direct from those Suppliers own warehouses. 

When you the Customer makes a purchase, that transaction is between you and the Supplier who owns, holds and dispatches the products.  The Supplier is show against each product description.

ClicBox Ltd does not own, transport nor dispatch any products, and is not party to any transaction.  ClicBox Ltd is an agent to the Supplier.

Where you the Customer make a purchase from a Supplier the Retailer whose name is on the DeliShop is not party to the sale, and at no point owns or is responsible for the goods sold.  They are the agent of the Supplier.

Where Retailers have their own products, and act as both Retailer and Supplier, this is clearly shown both in the search listings and against individual products.  In these instances, the Retailer is responsible for goods care and dispatch.

 

Terms and Conditions   

These Terms and Conditions ("ClicBox T&Cs") govern your use of the ClicBox DeliShop platform.

These are in addition to the Terms & Conditions of Suppliers.  Each Supplier has their own Terms & Conditions (“Supplier T&Cs”) which they must abide by. 

Supplier T&Cs govern the price and delivery of products, cancellation and refund policies and other terms and conditions of sale, some of which are referenced to below.

Please read the below carefully, as they relate to your purchase. If you do not agree to these ClicBox T&Cs and/or our Privacy Policy, please do not use this website service. By making a purchase on the site you are accepting these ClicBox T&Cs.

 

Terms of use     

i.              The DeliShop website is free to use, but by using it you consent to ClicBox T&Cs

ii.             When you purchase an item through the DeliShop, the legal contract is between you and the Supplier, the contact details for whom will be specified on your order confirmation.  This will never be ClicBox and may or may not be the Retailer the DeliShop through which you are making the purchase

iii.            Nothing in ClicBox T&Cs or the T&Cs of Suppliers affects your statutory rights

iv.           ClicBox T&Cs may be updated at any time and published in the DeliShop

v.            We reserve the right to refuse any transaction in any DeliShop

 

Registration

i.              To use this DeliShop you must be 18 years or over

ii.             It is your responsibility to ensure that your personal details for purchase, payment and despatch are complete and accurate

iii.            Payment will be required at confirmation of your order

 

Security

i.              It is your responsibility to keep the password to your account safe and confidential

ii.             You are responsible for all activities on your account under your password

iii.            Each order made under your password requires you to pay for the goods

iv.           If ClicBox are made aware of any security concerns regarding your account we may close or suspend your account. Please contact support@delishops.co.uk if you cannot access your account 

 

Product price

i.              Price is confirmed at the time of ordering and is set by the Supplier

ii.             Unless otherwise specified, items sold by weight will be at the set weights shown on the website and may vary according to the tolerances set down by the relevant Supplier in their Suppliers T&Cs

iii.            Prices include VAT where applicable

 

Availability and Substitutes

i.              All products are subject to availability

ii.             If a product is unavailable you will be contacted by email or telephone by the Supplier

iii.            DeliShops are unable to make substitutes

 

Alcohol

i.              To purchase alcohol you will be asked to confirm you are 18 years or over

ii.             If you select to collect direct from the Retailer via Click and Collect you may be asked to verify your age. We apologise if this is inconvenient for you

 

Delivery

i.              Delivery terms and charges are shown on the product page and at checkout

ii.             Delivery terms are subject to the Supplier T&Cs of each product. Delivery terms and Supplier T&Cs can be found in the tabs on the product page

iii.            Changes of address must be made on the website at or before the time of ordering

iv.           If you need to change the address after this time, please contact the Supplier directly.  Supplier details can be found here

v.            Items delivered in error will not be charged to your account.  Please notify the Supplier immediately if this is the case

 

Receipt of goods             

i.              It is your responsibility to inspect goods on delivery for defects and to check your delivery is correct against your order confirmation

ii.             You must notify the Supplier as soon as possible of any discrepancies or defective produce

iii.            Defective goods will be refunded. Do not dispose of defective items until you have received confirmation from the Supplier, as this could affect any refund you may be entitled to. It may be requested that you return the defective item to the Supplier

 

Payment             

i.              ClicBox Ltd takes your payment on behalf of the Supplier

ii.             Payment can be made by MasterCard, Visa, Maestro, JCB, Delta and Switch credit or debit cards

iii.            We accept PayPal

iv.           We do not accept American Express

v.            We do not accept cash or cheque

vi.           Payment is taken at the time the order is placed

vii.          There is no additional charge for credit cards

 

Changes to orders, cancellations and returns

i.              Changes, cancellations and returns of food goods are subject to the T&Cs of the Supplier from whom you have purchased

ii.             Suppliers are listed here and stated on your order confirmation

 

Perishable and customised goods

i.              Changes, cancellations and returns of food and customised goods are subject to the Supplier T&Cs from whom you have purchased. Suppliers are listed here and stated on your order confirmation

ii.             Refunds will only be given where goods are found to be defective on receipt.  Evidence such as a photograph, or the return of the goods, may be required as proof the goods are defective.

 

Other goods

i.              Changes, cancellations and returns of non-food goods are subject to the T&Cs of the Supplier from whom you have purchased.

ii.             The Supplier are listed here and is stated on your order confirmation.

iii.            You may cancel and return an item within 14 days of receipt by notifying the Supplier by email or telephone

iv.           For returns you are responsible for returning the goods to the Supplier including the costs of delivery back to the Supplier. We recommend you use a signed-for delivery service with proof of postage

v.            For a refund to be made, returned goods and their packaging for sale (but not transit) must be intact, unopened and undamaged, suitable for resale

 

Refunds

i.              Please refer to sections ‘Checking Your Delivery’ and ‘Changes to orders, cancellation and returns’

ii.             Refunds will be processed within 14 days after goods have been received and verified by the Supplier if requested

iii.            ClicBox Ltd process all refunds

iv.           It is the responsibility of your Supplier to request from ClicBox Ltd a refund

v.            If you are not happy with the service of your Supplier, you should contact ClicBox Ltd on support@delishops.co.uk

vi.           If you have not received your refund or a refund acknowledgement from the Supplier after 15 days, you should contact ClicBox direct on support@delishops.co.uk

 

Warranty            

i.              Warranties and guarantees are as per the T&Cs of the Supplier

ii.             No warranties or guarantees are given by ClicBox or the Retailer for products sold by Suppliers

iii.            The ClicBox platform gives no warranties for its use, or for general risks of using and buying products over the internet

iv.           We at ClicBox do our best to provide timely and accurate information regarding Suppliers products and purchase terms. We make no warranties or guarantees for goods and content appearing on it, it is the responsibility of the Supplier or Retailer to check and request any changes to incorrect information.

Technical concerns

While ClicBox will do all that is reasonable at any time to provide a safe easy to use platform, we disclaim all liability for

i.              Errors or interruptions to the DeliShop website

ii.             Incompatibility with any of your equipment

iii.            Malicious or dangerous software such as viruses

 

You agree

In the event ClicBox, the Supplier or the Retailer does not deliver against an intended purchase, ClicBox, the Supplier or the Retailer are not liable for

i.              Damage to your revenue, profits, or cost reductions, direct or indirect

ii.             Collateral expenditure, direct or indirect

iii.            Any other loss or damage arising from your use of the ClicBox DeliShop platform

iv.           Our liability is limited to the retail value of the goods purchased or intended to be purchased under this contract

v.            ClicBox, our Suppliers or our Retailers will not be deemed to have breached contract due to circumstances beyond our reasonable control

 

Complaints, concerns or comments

Viruses, hacking and other offences      

You must not misuse our Site or any part of the Service by introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.
